TERMS AND CONDITIONS OF THE OUTDOOR INN CROWD LIMITED

Who we are and how to contact us

We are The Outdoor Inn Crowd Limited trading as Outdoor Inns, a private limited company incorporated and registered in England and Wales with company number 13342016 whose registered office is at 48 Upper Brook Street, London, W1K 2BP and any references in these terms and conditions to “Outdoor Inns”, “we”, “us” or “our” are references to this legal entity.

Our contract with you

A binding legal contract is formed when you receive a booking confirmation from us, following our acceptance of your payment. That contract is made up of:

These terms and conditions; and

The booking confirmation.

This contract binds you (the person named on the booking confirmation) and all members of your party or group, including children. All members of your party or group must accept this contract, which remains in effect until the last member of your party or group has left our site.

Bookings and payment

You must book your stay with us through our website – www.outdoorinns.com. Please note that you must be over 18 to make a booking.

Please note that the full cost of the stay must be paid at the time you make your booking, using one of the payment formats prescribed by Outdoor Inns at that time (which include credit or debit card or Apple Pay).

By making your booking with us you confirm that:

You are legally capable of entering into a contract with us;

All information provided by you is correct;

You have full authority to make the booking on behalf of all and any persons on whose behalf you are making the booking; and

All persons named in the booking are aware of and accept these terms and conditions.

We reserve the right to accept or decline bookings at our discretion. If we cannot or do not accept your booking, we will inform you of the position and you will not be charged for the booking.

Bookings are accepted when we email to you a booking confirmation. Your booking confirmation will set out the accommodation you have booked, the dates of your booking, the number of guests, the total cost of your booking and the total amount paid for your booking. Please check the details on your booking confirmation carefully. It is your responsibility to check that all details in the booking confirmation are correct and to immediately notify us of any issues with the booking confirmation.

As the person making the booking, you will be responsible for all members of your party.

We can only discuss the booking (including any changes) with the person who made the booking; we cannot discuss the booking with another member of your party unless you give express consent for us to do so.

Please note that Outdoor Inns only offers short-term lets. We do not accept long term lets. The maximum permissible length of stay is 6 nights. After those 6 nights you (and any others in your party) will not be permitted to stay at any other Outdoor Inns locations for 6 nights.

Group bookings

Groups must have a nominated group leader who is responsible for making and overseeing the booking, including financial and legal responsibility.

Group leaders will be held responsible for overseeing the group and for the safeguarding, discipline and behaviour of their group.

Group leaders will also be responsible for any damage to the accommodation or its contents, or the site at which the group is staying which is caused by themselves or the group.

Groups of under 18s and over 18s must be family or have written consent from parents or guardians in order to share a cabin.

Cancellations and refunds

Your contract with us is a contract for the provision of leisure accommodation on a specific date or dates and this means that you do not have a statutory right to change your mind and cancel the contract. We do, however, offer you the right to cancel your contract subject to the provisions of this Clause 5.

If you wish to cancel your booking you must notify us, using one of the methods of contact set out at Clause 1.2 above and quoting your booking reference, at least one week prior to your arrival date. Your booking will be cancelled with effect from the date on which we receive your email or telephone notification and will be subject to the following cancellation charges:

Please note that this cancellation policy applies irrespective of the reason for cancellation, even if that is beyond your reasonable control. We strongly recommend that you take out comprehensive personal travel insurance for all members of your party for your holiday, including holidays in the UK. It is your responsibility to ensure that the insurance cover is adequate for your needs, including cancellation and curtailment for any reason. Please read your policy details carefully and take them with you on holiday.

Any refund payable to you in respect of cancellation of your booking will be automatically credited to you using the same payment format by which you paid for your booking.

Some of our cabins are located in some of the most remote, wild and beautiful parts of England. During periods of extreme weather we will endeavour to remain open and to keep you informed of the latest conditions. We recommend you check with us before commencing your journey. If we are open, but you choose not to travel because of the weather, this will be treated as a normal cancellation and the terms outlined above will apply.

If you want to make changes to your booking

Please note that, at this time, we are unable to accommodate changes to bookings. Changes must be treated as cancellations with the time frames and refund amounts as set out in Clause 5 above. You would therefore need to cancel your booking (giving us at least two weeks’ notice), receive a full refund and then make a new booking for a suitable date.

If we need to change or cancel your booking

In the usual course of events we would not expect to have to change your booking. However, circumstances sometimes arise which mean that we have to change or cancel your booking. If such circumstances do arise, we will inform you as soon as reasonably possible and will discuss the available options with you. These could involve:

Offering you a suitable alternative booking, which could be alternative accommodation for the dates of your original booking or the same or alternative accommodation for different dates; or

Cancelling your booking and giving you the opportunity to make another booking from Outdoor Inns on dates that are convenient to you (subject to the availability of accommodation); or

Cancelling your booking and giving you a full refund.

Evidence of identification

We reserve the right to ask for evidence of identification from any guest during your stay. Please ensure that you, and each member of your party or group, brings suitable identification evidence.

The following would be acceptable forms of identification:

Passport or a recognised national identity card which features a photograph;

Valid photographic driver’s licence;

Any other government-issued identification with details (names, date of birth) entered centrally by the issuing department, including identification for employees of fire or police services, armed forces, the NHS or employees of local authorities;

Photographic student identity card from a UK educational facility with a current admissions date;

A Travelcard with photograph;

UK citizen card: www.citizencard.com.

Your stay with us

There must be at least one capable and responsible adult over the age of 18 in each accommodation unit, who is responsible for the supervision of all members of your party or group who are under the age of 18. Children under the age of 18 remain the responsibility of their parents or guardians at all times.

Please note that you remain responsible for your personal belongings at all times. Please ensure that you lock your vehicle securely and remove any valuable items from view.

If you discover that anything is missing or damaged on arrival at your accommodation you must notify us immediately.

Please note that smoking is not permitted in any part of your accommodation. This includes use of vapes and/or e-cigarettes.

We insist upon reasonable standards of behaviour from all of our guests, During your stay, you and the members of your party or group must not:

Behave in a way which is excessively noisy or disruptive or which has a negative effect on the well-being and enjoyment of other guests;

Use the accommodation, or allow it to be used, for any dangerous, offensive, illegal or immoral activities;

Endanger the safety of our guests, staff or anyone else;

Cause damage to your accommodation or its contents or to the site at which you are staying;

Behave in a way which is offensive to or which causes any nuisance or annoyance to our guests, staff or anyone else; or

Behave in a way which is anti-social, abusive or otherwise unacceptable.

If you fail to comply with any of these requirements, we reserve the right at our discretion to require you and/or any member of your party or group to leave the accommodation and the site immediately and/or to refuse any future bookings from you. Should this situation arise, we would not be liable to pay any compensation or a refund and we would not be obliged to cover any expenses which may be incurred by you or the party concerned.

Should any prohibited behaviour outlined at Clause 9.5 above halt or interrupt our ability to continue to trade any bed, room or other product, you will be responsible for compensating us in full for all losses directly incurred as a result. Such behaviour or damage may lead to civil or criminal proceedings where appropriate.

You must keep the accommodation that you are staying in and its contents clean and tidy and leave them in the same condition as when you arrived. You are responsible for informing us of any damage to your accommodation or its contents as soon as possible. We reserve the right to charge for any extra cleaning to your accommodation, any missing items or any damage to your accommodation, its contents or the site at which you are staying which is caused by you or a member of your party or group during your stay (except reasonable wear and tear). If payable, such costs may be levied by us and would be payable by you prior to your departure. We also reserve the right to enter your accommodation at any time for any reasonable purpose.

As a group leader making a group booking, you also accept responsibility for the safeguarding and behaviour of your party. There should be at least one responsible adult on duty at all times, in order to ensure that all members of your party or group behave according to our policy.

You must also leave the property by the check-out time specified on your booking.

Pets

Well behaved pets are generally welcome at our sites, subject to our absolute discretion. You must check the position with us at the time you make your booking and obtain our express approval for your pet(s) prior to your stay.

If your pets are permitted to stay, please keep them under control at all times, ensure that they do no cause damage to your accommodation or the site at which you are staying and do not leave them alone or unsupervised in your accommodation at any time during your stay. You will be liable for any damage caused by your pet(s). Any damage is to be reported to Outdoor Inns immediately. Please note that any additional cleaning which may be required as a result of your pet(s) staying at your accommodation may incur an additional charge, at Outdoor Inns’ discretion.

For the safety and comfort of your pets we request that you exercise due diligence at all times, especially where accommodation is located near a road or livestock. It is your responsibility to ensure the safety of your pet(s) and we cannot accept any liability in this regard.

If any guest has an allergy to pets, please be aware that we cannot guarantee that a pet has not stayed in a particular property. We cannot accept responsibility for any suffering which may occur as a result of such animals having been present in a property.

If you have a problem or complaint

We take care to ensure that our accommodation and sites are of a high standard and always aim to provide the best possible holiday experience. However, if you have any complaint or problems during your stay, please notify us immediately during the stay itself. Our staff will try their best to resolve an issue or problem as quickly as possible so that you can continue to enjoy your stay.

We will aim to acknowledge your complaint within 1 working day of receiving it.

We will then review the information you have provided to us and investigate your complaint. This may involve reviewing internal inspection notes. This process can take some time to complete, so please allow approximately 7 working days for a final response. If it is not possible for us to provide a final response to you within this timescale, we will explain why and will confirm when we anticipate providing the final response.

General

Liability: Nothing in these terms and conditions is intended to limit liability for:

Death or personal injury caused by negligence;

Fraud or fraudulent misrepresentation.

Save for the claims at Clause 12.1 above, Outdoor Inns’ entire liability for all claims arising out of your stay with us will be limited to the value of your booking, minus any cancellation, amendment or other charges. We will not be responsible or have any liability for any matters that result from events which are beyond our reasonable control.

Data Protection: We will process any personal data provided by you in order to communicate with you about your booking and, from time to time, request feedback which will enable us to improve your future experience with us. For more information about how we are processing your personal data, please see our Privacy Policy on our website.

Entire agreement: This contract constitutes the entire agreement between Outdoor Inns and you and supersedes and extinguishes all previous agreements, promises, representations and undertakings (whether written or oral) relating to its subject matter.

Third party rights: This contract does not confer any rights on any person or party pursuant to the Contracts (Rights of Third Parties) Act 1999.

Waiver: Any failure by Outdoor Inns to enforce any right or provision in these terms and conditions will not constitute a waiver of such right or provision unless acknowledged and agreed to by us in writing. Except as expressly set forth in these terms and conditions, the exercise by either party of any of its remedies under these terms and conditions will be without prejudice to its other remedies under these terms and conditions or otherwise permitted under law.

Severance: If any part of our contract is or becomes invalid, illegal or unenforceable, it shall be deemed deleted, but that shall not affect the validity and enforceability of the rest of the contract.

Governing law: Your contract with Outdoor Inns and any dispute or claim relating to it shall be governed by and interpreted in accordance with the law of England and Wales and shall be subject to the exclusive jurisdiction of the courts of England and Wales.
